The Canadian Brewhouse (“CBH”) operates locations across British Columbia, Alberta, Saskatchewan, Manitoba, and Ontario through affiliated corporate entities. References to “CBH,” “we,” “us,” or “our” in this Privacy Policy mean the CBH entity that operates the applicable location or otherwise collects, uses or discloses your personal information, as applicable. We are committed to protecting your privacy in compliance with applicable federal and provincial privacy legislation. This Privacy Policy explains how we collect, use, disclose, and protect personal information through www.thecanadianbrewhouse.com, our mobile and desktop applications, and other services that link to this Policy (collectively, our “Sites”).

This Privacy Policy explains our practices regarding the collection, use, disclosure and protection of personal information. Where consent is required by law, we obtain consent appropriate to the circumstances.

1. Applicable Privacy Laws

CBH operates in multiple Canadian jurisdictions and is subject to applicable federal and provincial privacy legislation, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”), Alberta’s Personal Information Protection Act and British Columbia’s Personal Information Protection Act, as applicable. We handle personal information in accordance with the privacy legislation applicable to the relevant activity and jurisdiction.

2. Who We Are

The Canadian Brewhouse operates through affiliated corporate entities. The applicable CBH entity is the entity that operates in the relevant location or otherwise collects, uses or discloses your personal information, as applicable.

4. Scope of This Policy

This Policy applies to personal information we collect through our Sites and apps, through electronic communications, at our corporate and franchise locations, and through other interactions with CBH where this Policy is referenced or made available.

This Policy does not apply to personal information collected independently by third parties where CBH does not control the collection, use or disclosure of that information.

5. Children's Information

Our Sites are not directed to children, and we do not knowingly collect personal information from a child without the consent of a parent or guardian, consistent with PIPEDA’s and PIPA’s consent requirements. Canadian privacy law does not set a fixed age threshold; instead, consent must reflect the individual’s capacity to understand the nature and consequences of what they are consenting to. Where a child does not have that capacity, a parent or guardian must consent on their behalf. If you believe we have collected personal information from a child without appropriate consent, please contact our Privacy Officer at privacy@thecanadianbrewhouse.com so that we can review the circumstances and take appropriate action.

6. Information We Collect

6.1 Information You Provide to Us

We may collect personal information that you provide directly, including:

  • Name, address, email address, telephone number, birthday and social media handle.

  • Account and profile information, including information provided when registering for or using our Sites, apps or services.

  • Loyalty or rewards program information, including contact information and information associated with your participation in our loyalty or rewards programs.

  • Reservation, waitlist and online ordering information.

  • Entries into contests, promotions or surveys.

  • Correspondence and other information you provide when contacting or communicating with us.

  • Content you post to public areas of our Sites or otherwise submit to us (“User Contributions”).

  • Other information you voluntarily provide through our Sites, apps, locations or services.

User Contributions are posted or transmitted at your own risk. While we take reasonable measures to protect personal information, information you choose to make publicly available may be accessible to others.

6.2 Information Collected Automatically

As you navigate or use our Sites, apps and other digital services, we and our service providers may automatically collect certain information using cookies, pixels and similar technologies. This may include device and browser information, IP address, usage information, approximate location information and information about your interactions with our Sites, apps and digital services.

6.3 Cookies and Third-Party Tracking Technologies

We and our service providers may use cookies, pixels and similar technologies to operate and improve our Sites and apps, understand how they are used, measure the effectiveness of our advertising and, where applicable, provide or measure interest-based advertising.

7. How We Use Your Information

We use personal information, consistent with the purposes for which it was collected or as you separately consent, to:

  • Provide products or services you request and respond to your requests or comments.

  • Carry out our obligations and enforce our rights under any contract between you and us, including billing and collection.

  • Notify you of changes to our Sites, products, or services.

  • Administer interactive features, including online ordering, loyalty or rewards programs, related customer engagement activities, sweepstakes and surveys.

  • Send marketing communications, in accordance with Section 11 (Marketing Communications and CASL) below.

  • Any other purpose disclosed to you at the time of collection, or for which you separately consent.

8. Disclosure of Your Information

We may disclose aggregated or de-identified information that does not identify any individual without restriction.

We may disclose personal information:

  • To affiliated CBH entities and franchise or licensed locations where reasonably necessary to provide shared administrative, operational, technology or other services, or to facilitate products, services or programs in which you participate.

  • To other CBH Group brands for their own marketing or promotional purposes where you have provided consent or where otherwise permitted by law.

  • To service providers and contractors who perform services on our behalf, including payment processing, online ordering, loyalty or rewards programs, customer engagement services, marketing communications, analytics, IT hosting and other technology services.

  • To a buyer or successor in connection with a merger, acquisition, reorganization, sale of assets or similar business transaction.

  • To comply with applicable law, a court order, legal process, or a lawful request from a government or regulatory authority.

  • Where we reasonably believe disclosure is necessary to protect the rights, property or safety of CBH, our guests or others.

  • With your consent, or as otherwise permitted or required by law.

We require service providers that handle personal information on our behalf to use it only for authorized purposes and to maintain safeguards appropriate to the sensitivity of the information. We remain accountable for personal information under our control when it is processed by service providers on our behalf.

9. Cross-Border Processing of Personal Information

Some of our service providers may be located outside Canada or may store, process or access personal information outside Canada. These may include providers of analytics, social media, payment processing, email marketing, loyalty or rewards programs, customer engagement and other technology services.

As a result, personal information may be stored, processed or accessed in countries with data protection laws that differ from those in Canada and may be subject to access by courts, law enforcement or governmental authorities in those jurisdictions.

By using our Sites or voluntarily providing us with personal information, you consent to the collection, use, disclosure and processing of your personal information for the reasonable purposes identified in this Privacy Policy, including processing by service providers located outside Canada, where consent may reasonably be implied from the circumstances. Where express consent is required, we will obtain it separately.

10. Retention and Destruction of Personal Information

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by law, including applicable regulatory and record-keeping obligations. When personal information is no longer needed, we securely destroy, erase, or anonymize it. Typical retention periods are described where practical at the point of collection; for general inquiries about a specific retention period, contact our Privacy Officer (Section 3).

11. Marketing Communications and CASL

Where we send you commercial electronic messages (email, text, or other electronic messages promoting our products or services), we do so in compliance with Canada’s Anti-Spam Legislation (“CASL”). This means:

  • We will only send commercial electronic messages where we have your express or implied consent.

  • Every electronic commercial message will clearly identify us as the sender and include valid contact information.

  • Every message will include a functional unsubscribe mechanism, and any unsubscribe request will be honoured within 10 business days, at no cost to you.

You may withdraw your consent to receive marketing communications at any time by using the unsubscribe link in any message, adjusting your preferences in your account profile, or emailing us at the address in Section 3.

12. Your Choices

12.1 Cookies

You can set your browser to refuse all or some cookies, or to alert you when cookies are sent. If you disable cookies, some parts of our Sites may become inaccessible or function improperly.

12.2 Promotional Offers

If you do not want your contact information used to promote our own products or services, you can opt out through your account preferences in our app, or by replying to any promotional email or text asking to be removed from future communications.

12.3 Interest-Based Advertising

Some third parties that provide advertising or analytics services offer tools that allow you to manage your preferences regarding interest-based advertising. You can manage preferences for participating companies through the Digital Advertising Alliance of Canada (www.youradchoices.ca).

13. Accessing, Correcting, or Deleting Your Information

Depending on applicable law and the circumstances, you may have rights to access or request correction of your personal information, withdraw consent to certain uses, or request deletion where applicable. You can review and update information directly through your account profile, or by submitting a request to our Privacy Officer (Section 3).

We will generally respond within the timelines required by applicable privacy law and will provide notice where additional time is permitted and required. We may not be able to accommodate a request where doing so would violate a legal requirement or cause information to become inaccurate.

If you delete User Contributions from our Sites, copies may remain viewable in cached or archived pages or may have been copied or stored by other users. Use of information you post, including User Contributions, is also governed by our Terms of Use.

14. How We Protect Your Information

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, disclosure, loss or other risks. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
